Text 6

This text deals with the separation powers in the UK.

On this occasion Blackstone wrote that all the parts of English government has a mutual check upon each other. The two Houses keep each other from exceeding their proper limits due to their opposite interests.

Blackstone considered that Parliament was legally unlimited but it functioned within the common law.

This ideal conception was diluted by the realities of politics even in the eighteen century. Some modern commentators have therefore concluded that the separation of powers has little meaning today because the legislature is dominated by the executive.

Dicey's conception implies of an independent judiciary as a safeguard against both Parliament and the executive. Speaking about  the strict separation of powers as applied in France, Dicey regarded , that the rule of law does not require any particular kind of court.
